THE REGULATORY ASPECT
The real estate agent specializing in the sale or acquisition of real estate or goodwill practicing in Saint-Barthélemy holds a professional card issued by the Prefecture of Saint-Barthélemy and Saint-Martin or by the Chamber of Commerce and territorial industry for cards issued more recently.
To obtain the professional card, he must provide proof of professional aptitude (diploma or experience in an agency), the equivalences of which are fixed by ministerial order.
The Carte Professionnelle bears the mention “Transactions on real estate and goodwill”. If the real estate agent decides not to hold, directly or indirectly, funds on the occasion of all or part of the activities of sale or acquisition of real estate, the professional card then bears the mention "has undertaken not to collect funds” and this indication is displayed in its agency and its commercial documents. If he chooses to hold funds, he displays the words “can receive funds” and he must provide his financial guarantee for the amount of funds held (at least €110,000).
Finally, he must benefit from Professional Civil Liability (RCP) insurance against the financial consequences for which he could be held responsible.
